Biden Jr. was cognitively impaired during his time in office and that many of his executive decisions should be considered legally “void.”

The report, spearheaded by Republican Chairman James Comer of Kentucky, asserts—without presenting direct medical evidence—that Mr. Biden was so mentally diminished that he could not have personally authorized key actions, including the controversial pardon of his son, Hunter Biden.

Instead, the committee alleges that senior White House staff orchestrated a coordinated effort to conceal the president’s decline, effectively running the administration without his meaningful input.

Aides Accused of Cover-Up

According to the report, top Biden aides—including former chiefs of staff Jeff Zients and Ron Klain, communications adviser Anita Dunn, and personal physician Dr. Kevin O’Connor—took extraordinary steps to mask the president’s aging and cognitive challenges.

Examples cited include:

  • Limiting unscripted public appearances
  • Avoiding stairs or long walks during events
  • Debating whether to administer a cognitive test (ultimately deciding against it)
  • Using the autopen device to sign documents without direct supervision

The committee claims these actions amount to a “delusional” cover-up. Notably, several aides invoked their Fifth Amendment rights and declined to testify during the investigation.

Chairman Comer has formally requested Attorney General Pam Bondi to investigate whether Biden’s executive orders—including pardons and regulatory changes—were “duly authorized.”

Legal scholars widely reject the notion that a president’s actions can be retroactively nullified based on alleged cognitive decline without a formal incapacity determination under the 25th Amendment—which never occurred during Biden’s term.
